Marriage & Family Relations

The rules of Islamic marriage and married life.

📖 The importance of marriage in Islam

Marriage is a sacred institution in Islam, encouraged by Allah and His Prophet ﷺ. It is an act of worship that preserves chastity, builds a family and contributes to Muslim society.

"And of His signs is that He created for you from yourselves mates that you may find tranquility in them; and He placed between you affection and mercy."

— Quran, Ar-Rum (30:21)

"O young men! Whoever among you can afford it, let him marry, for it helps lower the gaze and preserve chastity."

— Reported by Al-Bukhari and Muslim — Exact reference and attribution to be confirmed.

Conditions for a valid marriage

For a marriage to be valid in Islam, the following conditions must be met:

✅ 1. Mutual consent

Both spouses must freely consent to the marriage. No forced marriage is valid.

✅ 2. The guardian (Wali) of the woman

According to the majority of scholars, the woman must have a guardian (father, brother, uncle...) who approves and represents her side in the contract.

"No marriage without a guardian." — Reported by Abu Dawud and At-Tirmidhi — Exact reference and attribution to be confirmed.

✅ 3. Two Muslim witnesses

The marriage must be witnessed by at least two honorable Muslim witnesses.

✅ 4. The dowry (Mahr)

The husband must offer a dowry to his wife. It belongs exclusively to the wife. The amount is free (can be symbolic or substantial).

✅ 5. The contract (Ijab and Qabul)

A clear offer and acceptance must be pronounced. E.g.: "I give you my daughter in marriage" / "I accept".

🟡 Recommended: Publicly announce the marriage, hold a walima (wedding feast), legally register the marriage according to the laws of the country.

Rights & Duties of spouses

👩 Wife's rights

  • • Receive her dowry
  • • Be provided for (housing, food, clothing)
  • • Be treated with kindness and respect
  • • Have her privacy preserved
  • • Keep her own property
  • • Be treated equitably (in case of polygamy)

👨 Husband's rights

  • • Be respected in his position of responsibility
  • • Have his home preserved
  • • That his wife does not allow into the home those he does not approve of
  • • Fidelity and marital intimacy

"Women have rights similar to those over them, according to what is reasonable. But men have a degree above them."

— Quran, Al-Baqarah (2:228)

🤝 Mutual duties

  • • Mutual love, mercy and kindness
  • • Absolute fidelity
  • • Cooperation in raising children
  • • Preserving the couple's secrets
  • • Supporting each other in obedience to Allah

Conflict resolution

Conflicts are natural in a couple. Islam prescribes steps to resolve them wisely:

1

Dialogue and patience

Communicate calmly, listen to each other, avoid hurtful words.

2

Reminder and exhortation

Remind each other of Allah's rights and the consequences of injustice.

3

Family mediation

Bring in an arbitrator from each family to reconcile. (Quran 4:35)

4

As a last resort: separation

If living together becomes impossible and unjust, divorce is permitted.

Divorce (Talaq) & Khul'

"The most hated of all lawful things to Allah is divorce."

— Abu Dawud 2178 — weak according to Al-Albani. This report is not an authenticated basis for a general ruling on divorce.

The legal ruling on divorce depends on the circumstances. Reconciliation may be sought when appropriate, but this report must not be used to pressure someone to remain in a harmful situation.

Talaq (divorce pronounced by the husband)

The man may pronounce divorce. He must do so outside the menstrual period and without prior intimacy in that cycle. A waiting period ('idda) of 3 menstrual cycles applies.

Khul' (divorce requested by the wife)

The wife may request divorce by relinquishing part or all of her dowry. The husband must agree or a judge can rule.

⚠️ Warnings

  • • Do not pronounce divorce in anger
  • • Do not use divorce as a threat
  • • After 3 divorces, reconciliation is only possible after an intermediate consummated marriage
  • • Respect the other's rights even after separation

✅ Practical summary

  • • Marriage requires: consent, guardian, witnesses, dowry, contract
  • • Spouses have mutual rights and duties based on kindness
  • • The man is responsible for maintaining the household
  • • Conflicts must be resolved through dialogue then mediation
  • • The ruling on divorce depends on the circumstances

❌ To avoid

  • • Secret marriage without witnesses (nikah as-sirr)
  • • Forcing someone into marriage
  • • Demanding an exorbitant dowry
  • • Mistreating one's spouse or depriving them of their rights
  • • Divorcing in anger or repeatedly
  • • Disclosing the couple's intimacy

Frequently asked questions

Is a symbolic dowry ($1) valid?

Yes, the dowry amount is free. A symbolic dowry is valid if both parties agree. However, it is recommended to give an honorable dowry according to one's means.

Is a remote marriage (by phone/video) valid?

Contemporary scholars disagree. Some permit it if conditions are met (witnesses, guardian, etc.) and identity is certain. Others require physical presence. Consult a scholar for your situation.

Is a civil marriage sufficient?

No, a civil marriage is not an Islamic marriage. A religious marriage with Islamic conditions must also be contracted. However, civil registration is recommended to protect rights.

Can a woman marry without a guardian?

According to the majority of scholars (except the Hanafi school), no. If she has no Muslim guardian, an imam or Islamic judge can fill this role.
